The Visale guarantee is available on request. Tenants must meet certain conditions to be eligible. This system makes it possible to ensure the rent security deposit to a lessor when the tenants of the accommodation are not able to pay it or present a guarantor.
The Visale guarantee is a system accessible on request until 2027. It is intended for rental candidates who cannot present a security deposit or deposit in the event of unpaid rent. If you do not have parents or family to act as guarantor, the State and the Action Logement group take on this responsibility and can provide up to 36 months of rents and unpaid charges to the private lessor. This exceptional deposit can be up to 9 months if the accommodation is social housing.
What is the Visale guarantee?
The Visale guarantee is a protection system which aims to insure the tenant and the lessor against unpaid rent. Clearly, with this system the State becomes the guarantor of a tenant who does not have sufficient resources to pay the security deposit when renting accommodation. On the other hand, this offers a guarantee to the lessor in the event of unpaid rent. Established in January 2016, the Visale guarantee replaces the old Rental Risk Guarantee (GRL) and Universal Rent Guarantee (GUL), deemed ineffective and no longer valid.
Which tenants are eligible to apply for a Visale guarantee?
The Visale guarantee is aimed at people who are unable to advance the rental security deposit. Remember that this deposit is equivalent to 1 or 2 months’ rent, depending on whether the accommodation is rented empty or furnished. The Visale guarantee is aimed at 4 categories of tenants:
- Employees in the private sector, whatever their age and employment contractearning less than 1,710 euros net per month, or hired for less than 6 months, or on professional mobility or benefiting from a promise of employment of less than 3 months.
- People under 30 years old regardless of their status and income.
- People eligible for lease mobility.
- People accommodated by a rental intermediation organization.
In principle, only private landlords are affected by the measure (individuals, real estate professionals, etc.). Under certain conditions, certain university residences may also be eligible. The accommodation can be furnished or empty but it must also meet certain conditions:
- Being a primary residence.
- Have a rent (charges included) of 1,940 euros, 1,575 euros, or 1,365 euros depending on the geographical area where the accommodation is located; specific ceilings exist for students and work-study students.
- Be decent and respect the Departmental Health Regulations (RSD).
- Be the subject of a lease (rental contract).
When to request the Visale guarantee from the Action Logement group?
As a general rule, the Visale guarantee request is made when the desired accommodation is available. It is carried out directly online on the Action Logement group website. The future tenant can also create their personal space in advance. All they need to do is upload the requested supporting documents. If accepted, the visa is validated for a given period and a maximum amount of guaranteed rent. The visa is then given to the lessor at the time of signing the lease.
How long is the visa guarantee?
Access to the Visale guarantee system is free, both for the tenant and the lessor. Whatever the cause of the non-payment, it covers the rent of the defaulting tenant over a period of 36 months. The tenant remains liable for these amounts to the intermediary organization, on the basis of a schedule established with them. If it does not respect it, Action Logement has the possibility of taking action to terminate the lease.
